| dc.description | The National Constituent Assembly was created by the Government Junta presided by José Figueres, who assumed power on May 8, 1948 and took the name of the Founding Junta of the Second Republic. That same day, the chapters on national, individual and social guarantees of the 1871 Constitution were reestablished. On September 13, 1948, the Junta called for elections to a Constituent Assembly that was inaugurated on January 15, 1949. The Assembly recognized the election of Otilio Ulate and ordered that he serve as the highest magistracy from 1949 to 1953. At that time, the Junta appointed a commission of jurists to prepare a draft Constitution. It was an extensive project, with great innovations and advanced ideas, but it was rejected by the Assembly. The basic model was the Constitution of 1871. Elements were also taken from the draft Constitution prepared by the Commission of Jurists. | es |
| dc.description.abstract | La Asamblea Nacional Constituyente se generó en la Junta de Gobierno presidida por José Figueres, quien asumió el poder el 8 de mayo de 1948 y tomó el nombre de Junta Fundadora de la Segunda República. Ese mismo día, se restablecieron los capítulos de garantías nacionales, individuales y sociales de la Constitución de 1871. El 13 de setiembre de 1948 la Junta convocó a elecciones a una Asamblea Constituyente que se inauguró el 15 de enero de 1949. Dicha Asamblea reconoció la elección de Otilio Ulate y dispuso que ejerciera la primera magistratura de 1949 a 1953. Para ese entonces, la Junta nombró una comisión de juristas para preparar un proyecto de Constitución. Fue un proyecto extenso, con grandes innovaciones e ideas de avanzada, pero fue desechado por la Asamblea. El modelo básico fue la Constitución de 1871. Se tomaron también elementos del proyecto de Constitución elaborado por la Comisión de Juristas. | es |
